A CHINESE restaurant due to open in Gravesend town centre has failed in its appeal to operate a take-away from the same premises.

Q To failed to persuade a Government planning inspector the new operation would not compromise highway safety.

The restaurant, due to open within the next two months, will be at the junction of The Grove and Milton Street, only a few shops away from the Sea Pearl Chinese take-away.

Mr To had an application for a take-away licence turned down in May.

In his conclusions, the inspector said a take-away service included delivery service, which would cause a traffic hazard.

He said: I have taken into account reference to take-aways making an important contribution to commercial success, but it does not outweigh the issue of highway safety.

A spokesman for Mr To said: We respect the decision of the planning inspector but have not taken a decision yet as to whether we will appeal to the High Court to overturn the decision.
